2. PURPOSE
2.1. Les présentes Conditions Générales de Vente (ci-après « C.G.V. »), définissent les termes et conditions selon lesquels toute personne (ci-après « le Client ») commande et achète les produits vendus par la société Love and Cakes (ci-après « Love and Cakes »), dans le cadre d'un système de vente à distance sur Internet et mobile, pour des marchandises définies au catalogue de vente des sites Internet et mobile www.loveandcakes.fr (ci-après « Le Site ») et de l’application Love and Cakes (ci-après l’Application Mobile).
3. APPLICATION OF CONDITIONS GENERAL SALES CONDITIONS
3.1. The present General Terms and Conditions of Sale are brought to the attention of the Customer to enable him to place an order.
3.2. The fact that the Customer completes an order on the Site or on the Mobile Application and confirms the order implies full acceptance of the present G.S.T., which alone shall be applicable to the following contract.

4. CHARACTERISTICS OF GOODS OFFERED
4.1. The products offered to the Customer are those listed in the catalog published on the Site or Mobile Application, subject to availability and the proper functioning of the Site or Mobile Application.
4.2. Chaque produit est présenté accompagné d’une photographie et d’un descriptif établi par Love and Cakes. Les descriptifs sont destinés à présenter au Client les caractéristiques essentielles des produits avant la prise de commande définitive et ne peuvent en aucun cas engager la responsabilité de Love and Cakes. Les photographies des produits sont fournies à titre indicatif, et ne sont pas contractuelles.
5. ORDER TAKING AND CONFIRMATION
5.1. La prise de commande sur le Site et l’Application Mobile implique l’ouverture d’un Compte Client par la saisie de deux identifiants : une adresse e-mail et un mot de passe. Ces identifiants sont et devront être tenus confidentiels. Le droit d'accès par le Client aux identifiants peut s’effectuer sur simple demande auprès du Service Clients Internet de Love and Cakes, qui répondra uniquement par e-mail à l’adresse utilisée lors de la création du Compte Client
5.2. To place an order, the Customer undertakes to fill in the order details accurately and precisely. To this end, he/she undertakes to fully complete the various sections necessary for the proper traitement of his/her order:

-Choice of billing address
-Choice of delivery address (for home delivery or delivery by courier)

5.4 Modifying an Internet order
For any order modification (billing address, delivery address, delivery date or order content), the Customer must contact contact with Internet Customer Service no later than 2 working days before the desired delivery date (3 working days for international deliveries). En cas de modification ou d’annulation de la commande ou des conditions de livraison, un avoir du montant correspondant sera transmis par e-mail au Client. Aucun remboursement ne pourra avoir lieu.Le Service Clients Internet est joignable du lundi au vendredi de 9h à 13h et de 14h à 17h.
5.5. Love and Cakes se réserve le droit de refuser une commande en cas de manquement du client à l'une de ses obligations, et plus généralement, de refuser toute commande présentant un caractère anormal ou incomplet pour quelque raison que ce soit. La commande n'est définitive qu'après confirmation par Love and Cakes. Love and Cakes confirmera au client l'acceptation de sa commande par mail ou, le cas échéant, son refus dans les 48 heures ouvrables suivant la saisie de sa commande sur Internet.
6. MEANS OF PAYMENT
6.1. Payment for products may be made by VISA, MASTERCARD, AMERICAN EXPRESS or PAYPAL, online from the ou l’Application Mobile, website via the secure payment system of Love and Cakes . Payment by credit card is validated immediately.
6.2. To be registered, the order must be paid in full. Unpaid orders cannot be processed.
7. PROOF
7.1. Love and Cakes via its hosting provider Squarespace, keeps purchase orders and invoices on its computer system and in reasonable security conditions .
7.2. Consequently, Squarespace's computerized records constitute a reliable and durable medium that may be produced as evidence.
8. RIGHT OF WITHDRAWAL
8.1. Le délai de rétractation de 7 jours ne s’applique pas pour les contrats de fourniture de produits périssables, agroalimentaires, telles que les marchandises vendues par Love and Cakes. Aussi, le Client ne saurait s’en prévaloir.
9. STOCK SHORTAGE
9.1. Products sold on the Site and Mobile Application are offered subject to availability. If a product becomes unavailable, it will be removed from the catalog of products available for distance selling as soon as possible.
9.2. Toutefois, en cas de rupture de stock, Love and Cakes prendra contact avec le Client par téléphone ou par e-mail dans les meilleurs délais afin de convenir avec lui :•de décaler la livraison en attendant le réapprovisionnement de ce produit, lorsque cela est possible•de remplacer le produit par un autre équivalent en qualité et prix.
9.3. Les produits Love and Cakes sont fabriqués de façon artisanale et sont disponibles en quantités limitées. À toutes fins utiles, il est important de noter que les commandes passées durant les périodes de fêtes (Fêtes de fin d’année notamment) pourront entraîner des risques de rupture de stocks plus importants comparativement à celles effectuées pendant les autres périodes de l'année.
10. PRICE
10.1. Les prix indiqués sur les bons de commandes et factures s’entendent en Euros TTC, au départ du laboratoire ou des points de vente Love and Cakes.
10.2. Delivery charges are invoiced in addition to the price of the goods. Delivery charges depend on the delivery method chosen (home delivery or delivery by courier), as well as the geographical area, weight and volume of the parcel.
11. DELIVERY OF PRODUCTS
11.1. Home deliveries are made to Paris and suburbs and throughout mainland France.
11.2. Le Client est responsable des informations relatives au nom et adresse du destinataire . Ces mentions doivent être précises, exactes, et complètes (notamment code de porte et étage ) pour permettre une livraison in conditions normal.
11.3. Love and Cakes ne pourra en aucun cas être tenu responsable d’un retour de livraison dû à une erreur d’adresse ou à une impossibilité de livrer à l’adresse indiquée.
11.4. Dans le cas où une adresse de livraison serait incomplète ou imprécise, Love and Cakes se réserve le droit de contacter directement le destinataire par téléphone, afin de compléter avec lui les informations de livraison manquantes dans la mesure où le numéro de téléphone ne serait pas erroné et le destinataire disponible.
11.5. Orders indicating a P.O. Box address cannot be taken into account and processed.
11.6 In the absence of the addressee or of a person who can take possession of the products at the time of delivery, and insofar as the carrier has access to the addressee's letterbox, the carrier will leave a calling card inviting the addressee to collect the product from a post office. In the case of delivery by courier, if the recipient is absent, the products will be returned to boutique.
En aucun cas, Love and Cakes ne saurait être tenu responsable d’une éventuelle détérioration des produits du fait de leur retrait tardif auprès du transporteur
11.7 Exceeding delivery times shall not give rise to claims for damages.
11.8. However, and subject to the limitations set out in dans les présentes C.G.V., when delivery is delayed by more than 48 working hours, the total amount of the order will be re-credited to the Customer in the form of a credit note. Delivery times cannot be guaranteed during holiday periods such as Christmas, Easter, Valentine's Day, Mother's Day, etc.... During these periods, orders delivered late will not be eligible for a credit note.
11.9. Finally, if the product, under the responsibility of the carrier, has not been delivered, for any other reason related to customs, strikes or damage or any other cause of force majeure as defined by the courts, the sale may then be cancelled and the Customer may obtain restitution of the price to the exclusion of any other compensation or damages.
.11.10. Dans le cas d’une commande en Retrait Boutique, le Client s’engage à venir retirer sa commande à la boutique Love and Cakes sélectionnée, le jour même et pendant le créneau horaire qu’il aura choisi.
Les produits étant périssables, Love and Cakes ne pourra conserver une commande qui aurait été oubliée par le Client. Toute commande oubliée ne saurait en aucun cas être remboursée.
12. CLAIMS AND RETURNS
12.1. The customer must ensure that the delivery conforms to the order. In order to be taken into account, any complaint must be made within 12 hours of receipt, given the perishable nature of the products.

12.3. En cas de litige relevant de la responsabilité de Love and Cakes et justifiant un avoir ou le remboursement de tout ou partie de la commande, le Client recevra une notification par e-mail dans un délai de 21 jours suivant la réclamation.
13. PRODUCT WARRANTY
13.1. Love and Cakes garantit au Client que les produits sont fabriqués et emballés selon des règles de qualité strictes, et conservés conformément aux normes en vigueur en France.
13.2. Toutefois, Love and Cakes ne saurait étendre sa garantie sur ses produits si le Client n’a pas respecté des conditions de conservation optimales, ou si celui-ci a consommé des produits au-delà de la date limite de conservation indiquée sur l'emballage.
14. INTELLECTUAL PROPERTY
14.1. Tous les éléments du Site et de l’Application Mobile (photographies, illustrations, pictogrammes, et descriptifs, logo, marque) sont et restent la propriété intellectuelle et exclusive de Love and Cakes
La reproduction, la représentation, l’exploitation, la rediffusion, ou l’utilisation à quelque titre que ce soit, même partiellement, des éléments du Site et de l’Application Mobile qu’ils soient logiciels, visuels ou sonores, sont soumis à l’autorisation expresse et préalable de Love and Cakes, titulaire de l’ensemble des droits de propriété intellectuelle.
15. PROTECTION OF PERSONAL DATA
15.1. En commandant via le Site ou l’Application Mobile, le Client consent à l'utilisation par Love and Cakes des données nominatives le concernant. Ces données sont nécessaires pour assurer le bon traitement des commandes.

15.3. Conformément aux articles 39 et 40 de la loi « informatique et libertés » du 6 janvier 1978, le Client bénéficie d’un droit d’accès et de rectification et de suppression des données qui le concernent. Pour exercer ce droit et obtenir communication des informations, le Client peut contacter Love and Cakes à l’adresse contact@loveandcakes.com

16. INDEPENDENCE OF CLAUSES
16.1. If any provision of these conditions general terms and conditions should be declared inapplicable or invalid for any reason whatsoever, such invalidity shall not affect the application or validity of the other provisions of the conditions general terms and conditions, the invalid or inapplicable provision being replaced by the closest possible provision.
17. FORCE MAJEURE
17.1. Ni la société Love and Cakes, ni le Client ne saurait être tenu responsable de toute inexécution, la non-exécution ou le retard dans l’exécution de l’une de ses obligations décrites dans les présentes C.G.V qui aurait pour origine un cas de force majeure.
17.2. Force majeure is defined as any external, unforeseeable and irresistible event within the meaning of article 1148 of the French Civil Code. The following are expressly considered to be cases of force majeure or fortuitous events, in addition to those generally accepted by the jurisprudence of French courts and tribunals: total or partial strikes, management strikes, riots, civil unrest, insurrections, wars, bad weather, epidemics, blockages of means of transport or supply for any reason whatsoever, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, legal or regulatory changes to forms of marketing, computer breakdowns, blockages in telecommunications, including telecommunications networks, any questioning of the mathematical foundations governing the theory of cryptographic algorithms used for public key infrastructures, and any other event beyond the control of the Parties preventing normal performance of the contract.
18. APPLICABLE LAW
18.1. The present conditions general sont régies exclusivement par la loi française. Le Tribunal de commerce Paris will have exclusive jurisdiction over any dispute or difference concerning them.
